TERMS & CONDITIONS

Definitions


Us/We/Our: Our company, Baileys of Salisbury (KSR Bedding LTD)

VAT: Value-added Tax

Force Majeure: Extreme events or circumstances outside our control; these events include but are not limited to war or civil war, acts of God, natural disasters, fire, court orders, epidemics or disease and government authority action.

Made to Order/Special order: An item configured by you, with us, where you have chosen selectable options for a product, e.g. by a range of fabric, by colour, by size, or by tension.

Stock order: A pre-made item held in stock by Us.

Online order: An order placed on our Website, by email, or over the phone.


Important Notice:


These Terms and Conditions apply exclusively to distance sales (online, telephone, and email orders). They are not applicable to in-store purchases, which are subject to separate terms and conditions provided at the point of sale.


Your Order


After submitting an Online order, you will receive an acknowledgement of the order placed, and we will provide a unique order number. Please note this number, as it is required for identification or tracking purposes.


This acknowledgement is not an acceptance of your order.


When your payment has been accepted and authorised, and we have determined the availability of your required products, you will receive an email confirming your order; this will then be regarded as a legally binding contract between You and Us.


  • In the unlikely event of a delivery delay, we will contact you. We can discuss the options or alternatives available to you.


The VAT amount will be shown on your order. In addition, our VAT registration number will also be shown on this document.


In rare instances, Force Majeure may impact our ability to perform the contract. In Force Majeure, our company may, at its absolute discretion, cancel any contract for the supply of goods or services according to the order form; or cancel the manufacture and/or delivery of the goods or services.

In these circumstances, our company will endeavour to discuss other suitable alternatives available to you.


We reserve the right not to accept any order if any of the following criteria are true:


  • We have insufficient stock to fulfil the order;

  • Any of the items ordered was incorrectly described or priced on the Website; or

  • Your payment was not authorised.


If we cancel your order, we will notify you as soon as possible, but in any event, within thirty days of cancellation. We will refund the amount paid in respect of the contract. We will not be obliged or liable for any compensation.


Comfort Trial Policies


We understand that comfort is personal. That's why we offer a selection of comfort trial options across certain brands. These trials allow for a one-time exchange if the mattress does not meet your expectations. Each trial has specific terms and conditions, outlined below.


100-Night Mattress Trial


Eligibility:


  • This trial is exclusively available when a qualifying mattress and a qualifying mattress protector are purchased together from Us.

  • Eligibility for the trial must be explicitly stated on your invoice at the time of purchase.


Trial Period:


  • The trial period commences on the date of delivery and spans 100 consecutive nights.


Conditions:


  • The qualifying mattress protector must be used continuously throughout the 100-night trial period.

  • The mattress must remain in a clean, hygienic, and undamaged condition.

  • Mattresses that are soiled, stained, or damaged will void the trial eligibility.

  • Assessment of hygiene and condition shall be at our sole discretion, and our decision shall be final.


Exchange Process:


  • Customers are required to sleep on the mattress for a minimum of 30 nights to allow for body adjustment.

  • If, after this period, the mattress does not meet your comfort expectations, you may request a one-time exchange for an alternative mattress.

  • To initiate an exchange, please contact us between the 31st and 100th night of the trial period.

  • We will coordinate with our suppliers to arrange the collection of the original mattress and the delivery of the replacement.

  • If the replacement mattress is of higher value, the price difference must be paid at the time of exchange.

  • No refund or credit will be provided if the replacement mattress is of lesser value.


Limitations:


  • Only one comfort exchange is permitted per qualifying purchase.

  • The 100-Night Mattress Trial does not apply to clearance items.

  • Free exchange is available within a 65-mile radius of our showroom; additional charges may apply for locations beyond this range.


Additional Notes:


  • This comfort promise is exchange-only; refunds are not available under this trial.


Harrison Spinks 100-Day Comfort Promise


Eligibility:


  • This trial is exclusively available when a Harrison Spinks mattress and a qualifying mattress protector are purchased together from Us.

  • Eligibility for the trial must be explicitly stated on your invoice at the time of purchase.


Trial Period:


  • The trial period commences on the date of delivery and spans 100 consecutive nights.


Conditions:


  • The qualifying mattress protector must be used continuously throughout the 100-night trial period.

  • The mattress must remain in a clean, hygienic, and undamaged condition.

  • Mattresses that are soiled, stained, or damaged will void the trial eligibility.

  • Assessment of hygiene and condition shall be at our sole discretion, and our decision shall be final.


Exchange Process:


  • Customers are required to sleep on the mattress for a minimum of 30 nights to allow for body adjustment.

  • If, after this period, the mattress does not meet your comfort expectations, you may request a one-time exchange for an alternative tension or a different Harrison Spinks model.

  • To initiate an exchange, please contact us between the 31st and 100th night of the trial period.

  • We will coordinate with Harrison Spinks to arrange the collection of the original mattress and the delivery of the replacement.

  • If the replacement mattress is of higher value, the price difference must be paid at the time of exchange.

  • No refund or credit will be provided if the replacement mattress is of lesser value.


Limitations:


  • Only one comfort exchange is permitted per qualifying purchase.

  • The 100-Day Harrison Spinks Comfort Promise does not apply to clearance items.

  • Free exchange is available within a 65-mile radius of our showroom; additional charges may apply for locations beyond this range.


Additional Notes:


  • This comfort promise is exchange-only; refunds are not available under this trial.


Somnus 100-Day Comfort Promise


Eligibility:


  • This trial is exclusively available when a Somnus mattress and a qualifying mattress protector are purchased together from Us.

  • Eligibility for the trial must be explicitly stated on your invoice at the time of purchase.


Trial Period:


  • The trial period commences on the date of delivery and spans 100 consecutive nights.


Conditions:


  • The qualifying mattress protector must be used continuously throughout the 100-night trial period.

  • The mattress must remain in a clean, hygienic, and undamaged condition.

  • Mattresses that are soiled, stained, or damaged will void the trial eligibility.

  • Assessment of hygiene and condition shall be at our sole discretion, and our decision shall be final.


Exchange Process:


  • Customers are required to sleep on the mattress for a minimum of 30 nights to allow for body adjustment.

  • If the replacement mattress is of higher value, the price difference must be paid at the time of exchange.

  • No refund or credit will be provided if the replacement mattress is of lesser value.

  • Only one comfort exchange is permitted per qualifying purchase.

  • The 100-Day Somnus Comfort Promise does not apply to clearance items.

  • Free exchange is available within a 65-mile radius of our showroom; additional charges may apply for locations beyond this range.


Additional Notes:


  • This comfort promise is exchange-only; refunds are not available under this trial.

  • The trial is void if the mattress is returned in a condition that does not meet the hygiene and care standards outlined above.


Enchanted House 90-Day Comfort Promise


Eligibility:


  • This trial is exclusively available when a Enchanted House mattress and a qualifying mattress protector are purchased together from Us.

  • Eligibility for the trial must be explicitly stated on your invoice at the time of purchase.


Trial Period:


  • The trial period commences on the date of delivery and spans 90 consecutive nights.


Conditions:


  • The qualifying mattress protector must be used continuously throughout the 90-night trial period.

  • The mattress must remain in a clean, hygienic, and undamaged condition.

  • Mattresses that are soiled, stained, or damaged will void the trial eligibility.

  • Assessment of hygiene and condition shall be at our sole discretion, and our decision shall be final.


Exchange Process:


  • Customers are required to sleep on the mattress for a minimum of 30 nights to allow for body adjustment.

  • If, after this period, the mattress does not meet your comfort expectations, you may request a one-time exchange for an alternative tension or a different Enchanted House model.

  • To initiate an exchange, please contact us between the 31st and 90th night of the trial period.

  • We will coordinate with Enchanted House to arrange the collection of the original mattress and the delivery of the replacement.

  • If the replacement mattress is of higher value, the price difference must be paid at the time of exchange.

  • No refund or credit will be provided if the replacement mattress is of lesser value.


Limitations:


  • Only one comfort exchange is permitted per qualifying purchase.

  • The 90-Day Enchanted House Comfort Promise does not apply to clearance items.

  • Free exchange is available within a 65-mile radius of our showroom; additional charges may apply for locations beyond this range.


Additional Notes:


  • This comfort promise is exchange-only; refunds are not available under this trial.

  • The trial is void if the mattress is returned in a condition that does not meet the hygiene and care standards outlined above.


Vispring 90-Day Comfort Promise


Eligibility:


  • Eligibility for the trial must be explicitly stated on your invoice at the time of purchase.


Trial Period:


  • The trial period commences on the date of delivery and spans 90 consecutive nights.


Conditions:


  • The mattress must remain in a clean, hygienic, and undamaged condition.

  • Mattresses that are soiled, stained, or damaged will void the trial eligibility.

  • Assessment of hygiene and condition shall be at our sole discretion, and our decision shall be final.


Exchange Process:


  • Customers are required to sleep on the mattress for a minimum of 30 nights to allow for body adjustment.

  • If, after this period, the mattress does not meet your comfort expectations, you may request a one-time exchange for an alternative tension of the same Vispring model you initially purchased.

  • To initiate an exchange, please contact us between the 31st and 90th night of the trial period.

  • We will coordinate with Vispring to arrange the collection of the original mattress and the delivery of the replacement.

  • If the replacement mattress is of higher value, the price difference must be paid at the time of exchange.

  • No refund or credit will be provided if the replacement mattress is of lesser value.


Limitations:


  • Only one comfort exchange is permitted per qualifying purchase.

  • The 90-Day Vispring Comfort Promise does not apply to clearance items.

  • Free exchange is available within a 65-mile radius of our showroom; additional charges may apply for locations beyond this range.


Additional Notes:


  • This comfort promise is exchange-only; refunds are not available under this trial.

  • The trial is void if the mattress is returned in a condition that does not meet the hygiene and care standards outlined above.


Important Notes (Applicable to All Trials Above)


  • Exchange Only: All comfort trial allows for a one-time exchange of your mattress. Refunds or store credits are not available under this policy.

  • Single Exchange: Only one comfort exchange is permitted per qualifying purchase.

  • Protector Requirement: If required as part of the Eligibility criteria, a mattress protector, sold by Us, must be used throughout the trial period.

  • Condition of Mattress: At the time of collection, the mattress must be in a clean, sanitary condition and free from stains, soiling, or damage. Any mattress that is found to be marked, soiled, or damaged will be declined for exchange. Failure to meet these standards will invalidate your eligibility under the comfort trial.

  • Charges: Collection and redelivery charges may apply if you live more than 65 miles from the store. If a charge applies, the cost will be made clear on your invoice by Us.

  • Documentation: Trial participation must be clearly stated on your invoice at the time of sale.


'Made to Order' or Special Orders


Unless otherwise clearly stated by us at the time of sale, all products are classified as Made to Order or Special Order items. This is because each product is ordered specifically for the individual customer and manufactured or configured to their chosen specifications, such as size, fabric, colour, or comfort level.


Due to the nature of our supply chain, all mattresses and divan sets are treated as Made to Order, even when supplied in standard sizes or specifications, unless they are explicitly marked as ‘stock’ on your invoice.


Made to Order or Special Order items are not subject to the statutory cooling-off period under the Consumer Contracts Regulations 2013, as we commission suppliers to manufacture or allocate these items on your behalf.


Where you are configuring (selecting options) to build your bespoke product and not selecting a pre-made product which is held in stock, this product will be made specifically to your chosen custom options and therefore becomes a Made to Order/Special Order product.


If your order is not a Special Order/Made to Order items are identified clearly in the applicable specification on your invoice.


Stock Orders


If, after ordering an item from our stock, you have reason to cancel your order, you may cancel your order at any time before the day of despatch. Please email Us at: beds@baileysofsalisbury.co.uk.

We will email a confirmation of your cancellation. You will receive a refund using the same method as your original order.


Special Conditions relating to certain Products


Due to the intimate nature of bed frames, divans, headboards, pillows, bedding, mattresses and mattress toppers, these products are exempt from your usual statutory rights of return once they have been unsealed. For health and hygiene reasons, any unsealed, used, soiled, or marked mattress or mattress topper is considered non-returnable unless there is a proven manufacturing fault.

Where a Comfort Trial has been agreed at the point of sale and is clearly stated on your invoice, the terms of that trial will apply. Please refer to the relevant Comfort Trial Policies section of these Terms and Conditions for full details. If no Comfort Trial is listed on your invoice, your purchase will be subject to our standard return policy, and no comfort exchange will be available.


The Price of Goods and Services


The price of goods and services will include VAT (value-added tax) at the applicable rate. Any changes in the VAT rate between the date of your order and the delivery date may change the cost shown and may require adjustment to the price payable where this occurs; we will inform you of any changes as soon as possible. You will be deemed to have accepted those changes unless you specifically tell us otherwise, or (where the order is a 'Stock Order' and not a 'Made to Order' or 'Special' Order) reject the goods on delivery.


Your order may show charges for delivery, assembly or another service. If you request a different service than initially requested, we reserve the right to apply additional charges to your order.


Pricing Policy


Any headline price indicated on our Website or in-store will align with our supplier's guidelines. The terminology used differs from one manufacturer to another. The following are just a few of the more commonly used terms:


Consumer Price Guide: the price the Brand, Manufacturer or Supplier suggests the Retailer should charge the consumer.

Retail Price Guide: the price the Brand or Manufacturer suggests the Retailer should charge the consumer.

Showroom Price Guide: the price the Brand or Manufacturer suggests the Retailer should charge the consumer.


Any lower price offered by us is a discounted price.


We pride ourselves on being exceptionally competitive in price. We have a policy; we are never knowingly beaten on Price or Service.


In the unlikely event, once brought to our attention, we will match or better our price if our competitor offers the identical item and service for a lower price.


Payment


We require full payment for goods and services before delivery.


We require a minimum 25% deposit of the total value of your order to confirm your order.


No Debit or Credit Card details submitted with an Online order will be stored directly by us when you place an order with us.


Delivery Times


Every reasonable effort will be made to adhere to the delivery dates stated at the initiation of your order; however, these dates should be viewed as an estimated period. Such dates will be provided in good faith and based upon the information provided to us by our suppliers at the time. Special orders can be delayed for reasons beyond the control of our suppliers.


We will not accept any liability for any loss or inconvenience for any delay in delivery.


Delivery of Goods


Where a delivery charge is applicable and stated at the time of purchase, any subsequent change of address may incur additional delivery costs.


We deliver by way of our own transport or a chosen carrier, depending on the nature of the products ordered or your delivery area.


Adequate and safe access to your room of choice is your responsibility, as is the provision of safe passage free from vulnerable items such as floor lamps, occasional furniture pictures or any other removable items which may hinder the delivery process.


If our operatives deem the delivery access unsafe or inappropriate, they may, at their discretion, decide to terminate the delivery pending at another time. If delivery is rescheduled under these circumstances, additional charges may apply.


If you are not available at the time of the attempted delivery, a card will be left advising you that We called. Please contact our delivery contractor or Us within 24 hours to make a new appointment. An alternative delivery date can be arranged, but further charges may apply.


If we do not hear from you within this period, the goods will likely be returned to us, and charges will apply in this instance.


Time of delivery is not of the essence in these terms and conditions except to the extent that we will fulfil all orders within 30 days of our acceptance of the order unless you expressly agree otherwise. We will not be liable for any loss or damage incurred by you through any reasonable delay due to unforeseen circumstances outside our company's reasonable control or any reasonable delivery rescheduling.


Where you have elected to have your goods delivered to a third-party carrier or other such establishment engaged by you, it is the responsibility of that entity or person to accept the delivery on your behalf and sign for it accordingly. We will not accept any responsibility, liability or damage after the signed acceptance.


Products


All our products are sourced responsibly, and most of our mattress and divan sets suppliers are members of the National Bedding Federation (NBF), which has rigorous rules and regulations to protect you from the use of inferior components and construction methods. They also give you the best industry-recognised levels of guarantee.


All products are sold subject to their particular Product Description, which sets out additional Specific Conditions related to that product, including, without limitation, terms and conditions concerning estimated delivery dates and times, warranties, after-sales service and guarantees.


We endeavour to ensure that all details, descriptions and prices of Products appearing on our Website were correct at the time when the relevant information was entered into our web system.


We strive to keep the information on our Website as up-to-date as possible. However, all information provided; (including Product Descriptions, Fabrics and other selectable options) appearing on this Website at any given time may not always reflect the position exactly at the precise moment you place an order. We can only guarantee a product's price once your order is accepted in accordance with our email order acceptance procedures.


Damaged or Defective Goods


If your goods are found to be defective, short-delivered or damaged, we require you to contact Us within 48 hours of delivery. We will contact you and arrange to replace the damaged or incorrectly delivered goods. The same applies to product shortages.


On occasions when faulty or damaged products require inspection, we will arrange a prompt inspection of the goods in question. The inspection appointment will be arranged as quickly as possible.

No unauthorised repairs or modifications should be made to the goods.


Any damage sustained to a customer's property during the delivery must be written on the delivery operative's delivery advice note.


We do not accept claims, liability, loss, or damage for any goods misused or assembled by you or any third party.


Consumer Contracts Regulations 2013


This legislation offers you the following cancellation rights when you buy online or by phone:


  • You are entitled to cancel your contract if you so wish, provided that you exercise your right no longer than 14 days after the day on which you receive the goods or services.

  • Your right to return products does not apply to Made to Order or Special Order goods made to your specification and have been clearly personalised or which, because of their nature, cannot be returned. Mattresses and mattress toppers that have been unsealed are also excluded from your statutory right to return due to their nature as personal items.

  • If you wish to exercise your right of cancellation, you are obliged to retain possession of the goods and take reasonable care of them.

  • To exercise the right to cancel, you must inform us of your decision to cancel your contract by a clear statement, including details of your name, geographical address, details of the order you wish to cancel and your phone number and email address.

  • You can cancel by emailing Us at beds@baileysofsalisbury.co.uk.

  • If you decide to cancel, you should return the goods to us at your cost within 14 days of such cancellation, and we will reimburse you (by the method used to pay for the original transaction) the amount in relation to the goods to which cancellation rights apply. Including the cost of delivery (except for the supplementary costs arising if you choose a type of delivery other than our standard and least expensive method of delivery).

  • We may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of unnecessary handling by you. We will make the reimbursement no later than 14 days after the day we receive back from you any goods supplied.


Returns, Refunds, Cancellations and Cooling-off Period


We comply with the Distance Selling Regulations, and you may cancel your order during a cooling-off period. This cooling-off period is any time up to 14 working days after the day we have delivered the product to you.*


*Please refer to the 'Made to Order' or Special orders section and the Special Conditions relating to certain Products section for specific provisions relating to these items.


Where the goods are being returned for reasons other than being defective a charge will apply for the collection and return of such goods.


Please contact Us if you wish to discuss this charge before placing your order.


Returnable for credit goods must be made available in their delivered form and original packing and must not have been tampered with in any way. Only where our operatives assembled your goods in the initial instance will we disassemble these goods before removal.


On return, all products will be inspected to ensure the product has not been compromised and is complete before a refund is processed.


Where a refund is due, we will refund the sum due to you by the same method as originally paid by you unless otherwise agreed by Us. We will make every effort to complete this process as soon as possible unless unreasonable delays have been caused by you when enacting the return of the goods to our agent or Us.

Any cancellation request must be submitted by letter or email and directed to our head office, as shown in our Contact Us section below.


Please refer to the 'Made to Order' or Special orders section and the Special Conditions relating to certain Products section for specific provisions relating to these items before submitting a cancellation request.

Guarantee and Indemnity


The Customer is responsible for reimbursing Us and indemnifying Us against any actions, including claims, losses, damages, and actions incurred arising from Us acting on the directions or instructions from the Customer or the Customer's own actions.


Risk And Title


Ownership of the Goods shall only pass to the Customer when We receive cleared funds amounting to the full value of the order.


Ownership of the goods will remain with Us, and We will be entitled to dispose of them at any time before the receipt of payment in full for any Products or services supplied after having notified the Customer of such action.


The Risk for loss or damage to the Goods shall pass to the Customer on delivery to the Customer (or delivery to a third-party carrier nominated by the Customer).


It is understood that it is the Customer's responsibility to insure and protect goods awaiting exchange or collection.


Law And Jurisdiction


Any contract to which these terms and conditions apply shall be governed in accordance with English law, and the parties hereto submit to the non-exclusive jurisdiction of the English Courts.

Disclaimer


We work tirelessly to ensure the accuracy of our Website. Unfortunately, with many configurable products on offer, it is impossible to guarantee there won't be any errors. We will continue to rectify any errors as soon as possible but cannot accept responsibility for any losses incurred.


Our liability regarding any contract shall be limited to the value of the goods.

We reserve the right to:

  • Change prices without notice

  • Remove or change product content.

  • Update our terms and conditions, and your continued use of the Website (or any part of it) following such a change will demonstrate your acceptance of the change.

We would be grateful if you would report any errors you may find on our Website to us as soon as possible, and we will rectify them at the earliest possible time.


Waiver


If any part or individual part of these terms and conditions is determined by a court to be invalid, void or unenforceable, those terms only shall be deemed to have been deleted notwithstanding that all of the other remaining conditions within this contract shall remain in full force and effect.
